SERVICE AGREEMENT & TERMS OF SERVICE

Duty To Scoop LLC

1. Introduction

By scheduling or utilizing services provided by Duty To Scoop LLC (“Company,” “we,” “us”), you (“Customer”) agree to the terms and conditions set forth below. If you do not agree, please do not use our services.

2. Service Area

We currently serve Walla Walla and College Place, Washington. Service areas may expand or change without notice.

3. Services Provided & Routing

We offer pet waste removal, optional yard deodorizing, sanitization services, and leaf removal.

  • Frequency: Services may be scheduled Weekly, Bi-Weekly (Twice Monthly), Monthly, or as One-Time cleanings.
  • Route Optimization: To maintain competitive pricing and efficiency, we do not offer specific appointment times. Service days are subject to change due to route optimization, weather, or operational needs. We will provide notice of schedule changes when reasonably possible.

4. Sanitization & Deodorization Disclaimer

Crucial Health & Safety Limitations

A. Nature of Service (Reduction vs. Elimination) While Duty To Scoop LLC utilizes veterinary-grade disinfectants (such as Accelerated Hydrogen Peroxide) proven to effectively neutralize pathogens including Canine Parvovirus, Distemper, and Bordetella on hard, non-porous surfaces, this service is designed to reduce viral and bacterial load, not to achieve total sterilization.

B. Environmental Limitations The Client acknowledges that complete disinfection of outdoor environments is scientifically impossible due to:

  • Porous Surfaces: Soil, grass, mulch, and wood absorb liquid disinfectants, reducing their ability to maintain the necessary contact time to kill 100% of pathogens.
  • Organic Matter: Biological material (microscopic waste, leaves, dirt) can shield viruses from chemical contact.
  • Environmental Factors: Rain, UV exposure, and ground moisture affect the longevity and potency of applied treatments.

C. Health & Liability Waiver Duty To Scoop LLC provides sanitization as a preventative hygiene measure, not a medical guarantee.

  • No Guarantee of Health: We cannot and do not guarantee that our services will prevent your pet from contracting an illness.
  • Vaccination Responsibility: The Client agrees that they are solely responsible for maintaining their pet’s vaccinations and veterinary care. Reliance on yard sanitization as a substitute for vaccination is done at the Client’s own risk.
  • Release of Liability: By purchasing this service, the Client releases Duty To Scoop LLC, its owners, and employees from any liability regarding pet illness, veterinary bills, or health conditions that may arise before, during, or after our services are performed.

5. Leaf Removal & Yard Cleanup Specific Terms

A. “Broom Clean” Standard Leaf removal is performed to a “broom clean” standard. While we strive for excellence, the Customer acknowledges that it is impossible to remove every single leaf, pine needle, or piece of debris, especially those trapped in shrubs, rock beds, or tall grass. Small amounts of residual debris may remain.

B. Wet Leaves & Weather Conditions Weather significantly impacts leaf removal. If leaves are wet, frozen, or matted, the service may take longer or require rescheduling.

  • Pricing Adjustments: Estimates are based on dry conditions. Duty To Scoop LLC reserves the right to adjust final pricing if the volume of leaves is significantly heavier or deeper than visually estimated due to moisture or compaction.
  • Scheduling: Service dates are subject to change based on rain, snow, or wind conditions.

C. Hidden Hazards & Damage Waiver Thick leaf coverage often hides yard objects. Duty To Scoop LLC is not liable for damage to hidden items including but not limited to:

  • Sprinkler heads, valve box covers, or landscape lighting not clearly marked by the Customer.
  • Toys, hoses, dog cables, or garden tools left under the leaves.
  • Loose landscape edging or hidden wires.

D. Turf Condition Aggressive raking or powerful blowers may occasionally disturb loose soil or weak turf, especially in wet conditions. The Customer accepts this risk as part of the leaf removal process.

E. Hidden Waste Policy (The “Smear” Disclaimer) If Duty To Scoop LLC is hired for leaf removal without a concurrent Poop Scoop service, or if fresh waste has been deposited after our scoop but before the leaf removal:

  • We are not responsible for waste that becomes smeared or spread during the raking/blowing process.
  • If excessive hidden waste is found, we reserve the right to halt service and require a Scoop Add-On fee before continuing.

6. Access & Customer Responsibilities

  • Access: Gates must be unlocked, and all obstructions removed on your scheduled service day.
  • Locked Gate Policy: If we cannot access your yard due to a locked gate or obstruction, the service visit will be skipped and charged at the full rate. We may attempt to reschedule at our discretion, but are not obligated to do so.
  • Pet Safety: Pets must be secured inside or away from the service area during our visit.
  • Escaped Pets: While we are diligent about closing gates, Duty To Scoop LLC is not liable for pets that escape due to faulty latches, unsecured fences, or gates left open by third parties.

7. Billing, Payments & Refunds

  • Payment Terms: Payment is due before or at the time of service. Monthly subscribers are auto-billed on their signup date.
  • Late Fees: A $10 late fee applies if payment is over 7 days late.
  • Refund Policy:
    • No Refunds After Service: Once a service visit has been completed (or attempted but blocked by the customer), all charges are final and non-refundable.
    • Cancellations: Refunds are only available if cancellation is made at least 24 hours before the scheduled service.
    • Satisfaction Guarantee: If we missed a spot, please contact us within 24 hours, and we will rectify the issue.

8. Scheduling & Cancellations

  • Rescheduling: Please provide 24 hours’ notice to reschedule. Late cancellations (less than 24 hours) may incur a 50% charge.
  • Subscription Cancellation: To cancel a recurring subscription without penalty, you must provide 48 hours’ notice before the next billing cycle/visit.

9. Optional Dog Treat Consent

At checkout, customers may opt-in to allow us to leave complimentary Milk-Bone® (or similar) treats.

  • Assumption of Risk: By opting in, the Customer agrees that Duty To Scoop LLC is not liable for any illness, allergic reaction, or injury related to treat consumption.
  • Owner Responsibility: The Customer assumes full responsibility for determining if these treats are appropriate for their dog’s dietary needs.

10. General Liability Limitations

Duty To Scoop LLC is not responsible for:

  • Hidden yard hazards (e.g., sprinkler heads, underground wires) not clearly marked.
  • Wear and tear on yard surfaces due to normal foot traffic.
  • Odors arising from long-term waste buildup prior to our first visit.

11. Termination of Service

Duty To Scoop LLC reserves the right to terminate service immediately and without refund for rude, unsafe, or threatening behavior toward our staff.
